Prenuptial and postnuptial agreements
A prenuptial agreement is an agreement that couples may establish before getting married. These agreements outline asset ownership and financial responsibilities and how finances, property, and so on would be divided if you divorced.
Postnuptial agreements also serve this purpose, although they are entered into once a couple is married.
We know that approaching the topic of postnuptial agreements can be delicate, and we are here to help you and your partner have those discussions sensitively. Our specialist Family Solicitors in Witney can help you draft a pre- or postnuptial agreement that suits your needs. For more information, please contact our Family Law specialists.
Cohabitation agreements
If you are living with a partner but are not married, you will not have the same legal and financial rights afforded to married couples. This can become a problem if you and your partner later end your relationship and are tasked with dividing your finances.
Our Family Law Solicitors in Witney can help you draft a cohabitation agreement that reflects your situation and protects you as a cohabitating couple.
These agreements outline each partner's rights and responsibilities, covering matters such as savings, property, and children.

Alternative dispute resolution
Many individuals and families might worry about the prospect of going to Court to resolve their legal issues. Rest assured, we can deal with most cases through Alternative Dispute Resolution (ADR) methods, meaning that you will not need to go to Court if these methods are successful.
We can help with various ADR methods, including Family Mediation, collaborative law, and arbitration. Each process is slightly different, and we can help you decide which best suits your circumstances.

Our specialist Family Solicitors can help you to put Court Orders in place to prevent the perpetrator from continuing their abusive behaviour and/or to stop them from coming near you, contacting you, or continuing to live in your shared home.

What is the process of getting a divorce?
If you have reached the difficult decision to file for divorce, there are several steps involved, and we are here to support you as much or as little as you require.
The first step is to fill out a divorce application form stating that your relationship has irretrievably broken down. You must also send documents, including your marriage certificate, with your application.
Once your divorce application has been approved, you are then required to wait twenty weeks before applying for a Conditional Order. The Order essentially states that the Court sees no reason why you should not be granted a divorce. Upon receiving the Conditional Order, you will need to wait a further six weeks before you can apply for a Final Order, confirming your marriage's legal ending.
It is advisable to consult a Divorce Solicitor from the beginning, who can guide you through the entire process. We will also help you reach a financial settlement and make legal arrangements for any children you have.
