Domestic Abuse Solicitors

What is domestic abuse?

Domestic abuse can be physical, emotional, sexual or financial. Whether it is a single distressing incident or a pattern of recurring actions, our Domestic Abuse Solicitors are here to advise as to the best path for your safety.

Domestic abuse legal measures

Where any form of abuse has taken place, it might be sufficient to send the perpetrator a warning letter about their behaviour advising that it is unacceptable and that any further abuse may result in an application to the Court.

Should this not be successful or it is not suitable in your particular situation, an application is made to the Court who has the power to grant an injunction ordering the perpetrator to:-

  1. Refrain from any act of violence, threat or behaviour towards you and/or your child(ren) which is considered harassing, intimidating or threatening; and/or
  2. Leave a particular address to allow for your peaceful occupation; and/or
  3. Prevent their return to a particular address which can also include a specific area.

In an emergency, Orders can be obtained very quickly and without the perpetrator being made aware at the application stage.  

Once an injunction has been issued by the Court, a breach of this can be an arrestable offence and could be punishable by imprisonment and/or a fine.

Defending an accusation of domestic abuse

If you have been accused of abusive behaviour unfairly or maliciously, if unchallenged, this could have a detrimental effect on you and your reputation, so it is important that you seek legal advice from experienced lawyers.  

Domestic abuse financial options

You may be entitled to Legal Aid to assist you to apply for, or defend, an application for an injunction. While we are not able to offer Legal Aid, we do offer a free initial consultation for you to discuss your situation with a specialised Domestic Abuse Solicitor.  We can discuss your options with you and, if you do not wish to apply for Legal Aid or it is not suitable, we can provide support, advice and full representation throughout the Court process.
